How to form a Belize offshore trust

In order for a Belize trust to come into existence there must be a settlor, trustee, beneficiary/beneficiaries and a protector. The settlor will create the trust and deposit their assets into the trust entity for the benefit of the nominated beneficiaries, while the trustee will undertake the general management and administration of the trust. A protector is enlisted for the purpose of supervising the management of the trust to ensure it is in accordance with the trust laws and trust deed.

All Belize trusts must be compliant with the Trust Act 2010.

The Trust Act 2010 stipulates that a Belize trust can moved from Belize to another offshore jurisdiction and vice versa and where the Belize trust is moved, Belize laws no longer apply to it. It is also provided under the act that in order to initiate the creation of a Belize offshore trust, the settlor must apply via written instrument and not a basic oral declaration.

It is important to understand all applicable requirements and restrictions of setting up a Belize trust, for example, if the trust is established for charitable purposes there is a requirement that the trust has a minimum of four trustees.
