Benefits of creating a will

There are numerous benefits to creating a will, although many people across the globe fail to prepare one during their lives. Setting up a will allows for complete control over the future of one’s assets, provided that the procedure is correctly completed in compliance with legal regulations.

The importance of creating a will

In setting up a will, you will be given complete control over the disposition of your estate upon your death. This means that you will have complete say over what happens to your estate, the amounts and proportions that will be distributed and how those assets will be distributed. This will also avoid family disputes in the case where a will has failed to be produced.

Setting up a will also means the avoidance of complex intestacy laws, which will be activated when there is no materialization of a legally valid will. Legal procedures are often complex, time-consuming and extremely costly, and usually result in an estate being distributed to individuals who had little or no contact with the person in question. Thus establishing a will ensures the avoidance of distress to family members and the correct distribution of your assets.

Establishing a will also allows you to name a personal representative to supervise the settlement of your estate. This is also known as a Power of Attorney, who should be a close family member or someone who you place great levels of trust in, as they may be required to take full control of your assets.

A will also allows for the appointment of a guardian for minor children or aged parents. Without a legally valid will, this could result in a lengthy court case where one’s children end up in the care of a foster home after an extensive court battle. Establishing a will is the most advisable step if you wish to dictate your final wishes within a legally valid document.
