What is a Trust Beneficiary
When forming a trust it is important to have beneficiaries, as this is the primary reason for establishing a trust. A trust is a legal entity that is created for the advantage of the beneficiaries. The beneficiary is simply the person or persons who benefit from the formation of a trust. In trust law, a beneficiary is a person who is granted the equitable title of the contents of a trust, however in many trusts, the beneficiaries have no involvement in the formation stages of the trust, but will simply benefit from the assets placed within the trust.
In many trusts, not only does the beneficiary have no control over the formation of the trust, but they also have no control over it once the trust has been set up. Nevertheless in some trust formations, the beneficiary is entitled to take ownership and control of the trust and may also be given additional duties and powers that have been assigned in the trust deed.
Although trust law differs from one jurisdiction to another, in many locations, a trust is a flexible entity that can be changed if desired. Trusts are generally easier to amend than other legal documents, such as wills, and can be modified if required at the request of an Amendment. Therefore if there is a wish to add or change beneficiaries, a signed and dated Amendment to the Trust must be made in writing, explaining the changes and specifying the new additions or deletions.
Who can be a Trust Beneficiary
Selecting a beneficiary is a personal decision that can only be made by the settlor and it is important to assess all possibilities when establishing the beneficiaries. Any natural person can be a beneficiary and it is entirely up to the settlor to decide who the beneficiaries of the trust are going to be.
