What constitutes a Cyprus Trust

A trust in Cyprus is known officially as a Cyprus International Trust. In order for a Cyprus International Trust to come into effect, the following prerequisites must be met.  Firstly the settlor must not be a permanent resident in Cyprus, whilst a minimum of one trustee must permanently reside in Cyprus. Trust beneficiaries are not permitted to be permanent residents in Cyprus, and lastly, the trust property must not include any immovable property in Cyprus.

A Cyprus International Trust is regulated by Cyprus Trust Law (The International Trusts Law 1992) which is modeled in a very similar way to English Trust Law. As such, it proves to be a favorable location for many foreign investors seeking asset protection.

Cyprus Trust Formation

The legal structure of a Cyprus International Trust incorporates the need of a Settlor, Trustee, Beneficiary and Protector. The settlor initiates the creation of the trust and transfers or ‘settles’ the assets of the trust. The trustee is nominated by the settlor and must be an adult of sound mind. The trustee effectively is the person responsible for managing the assets for the benefit of a person or group of people, known as the beneficiaries.  The protector plays an important role in the management of the trust by monitoring the activity of the trust to ensure compliance with the trust deed.
